1988 Cultivating Spaces SRL is liable to the buyer for any lack of conformity existing at the time of delivery or detected within 2 years, due to manufacturing defects, in accordance with applicable Romanian legislation: Government Ordinance 140/2021, Law 296/2004, Government Ordinance 21/1992, and Directive 2019/771, as well as any other relevant consumer protection legislation in force.
Any non-conformities, statements, or deficiencies should be submitted in writing to the address: Bd. Ficusului 44A, Sector 1, Bucharest, Romania, addressed to 1988 Cultivating Spaces, or electronically notified to the seller via email: studio@1988cultivatingspaces.com.
Buyer’s/Seller’s Rights
The buyer may request the repair or replacement of goods that cannot be used for the intended purpose due to hidden defects discovered after purchase, within 2 years from the date of purchase, under the conditions stipulated by law.
In case of non-conformity, the buyer has the right to request bringing the goods into conformity, to request a proportional price reduction, or to terminate the contract under the conditions provided by law.
To bring the goods into conformity, the buyer may choose between repair and replacement, except when the chosen remedy is impossible or would impose disproportionate costs on the seller, considering all the circumstances, including:
a) the value of the goods if there had been no non-conformity;
b) the severity of the non-conformity; or
c) whether the alternative remedy could be carried out without significant inconvenience to the consumer.
Buyers may choose a specific remedy if the non-conformity is detected shortly after delivery, not exceeding 30 calendar days, according to Government Ordinance 140/2021, Art. 11, point 7.
The buyer is not entitled to terminate the contract if the non-conformity is minor. The burden of proof regarding the minor nature of the non-conformity lies with the seller.
The seller may refuse to bring the goods into conformity if repair or replacement is impossible or would impose disproportionate costs, considering all the circumstances, including those provided in paragraph (2) letters a) and b), Art. 11 of Government Ordinance 140/2021.
Repairs or replacements must be carried out under the following conditions:
a) at no cost;
b) within a reasonable time not exceeding 15 calendar days from the time the seller was informed by the consumer about the non-conformity, and agreed upon in writing between the seller and the consumer;
c) without significant inconvenience to the consumer, considering the nature of the goods and the purpose for which the consumer requested the goods.
THE PRODUCT DOES NOT BENEFIT FROM A LEGAL CONFORMITY WARRANTY IN THE FOLLOWING CASES:
- The transport, handling, installation, use, and maintenance instructions provided have not been followed.
- The power supply voltage exceeds the limits set by standards (SR EN 50160).
- The user’s electrical installation presents makeshift repairs or non-conformities.
- The product was used for purposes other than those for which it was designed.
- The product has undergone interventions (repairs, modifications) by unauthorized persons.
- The defect is due to the consumer’s failure to follow the usage instructions provided in the technical documents accompanying the product.
